During our meeting, we will explore the following components of effective estate planning as they relate to your circumstances. This will help ensure that all aspects of your estate are managed according to your wishes.

Executors

Your executors administer your estate and carry out your wishes. They inform relevant parties of your passing and manage your assets, either distributing them to beneficiaries or holding them in trust. You can appoint up to four executors and replacements if needed. Executors also manage your estate for young children until they inherit. We will discuss your options and help you choose the best executors for your situation.

Attorneys

Attorneys make decisions on your behalf if you’re unable to. They support you by managing your home, your medical treatment and your care. You can appoint up to four attorneys and up to four replacements. We will talk through your choices to ensure you have the right people in place.

Guardians

Guardians care for children under 18 if both parents have died. They make day-to-day welfare decisions and work closely with executors who manage the children’s inheritance until they turn 18. You can appoint multiple guardians and replacements. We will help you consider the best guardians for your children and how they will work with your executors.

Beneficiaries

Decide who benefits from your estate and how. This may include your spouse, children, or other loved ones. Consider what happens if a beneficiary predeceases you. You can leave assets outright or in a trust to protect against risks like legal proceedings and inheritance tax, and help preserve means-tested benefits. We will discuss your wishes and how to best structure your estate to meet your goals.

Joint Property Ownership

Property can be owned as Joint Tenants or Tenants in Common. Joint Tenants pass property to the survivor, while Tenants in Common pass their share according to their Will. Trusts in Wills require owning property as Tenants in Common. We will review how you own your property and discuss any necessary changes.

Inheritance Tax

Learn how inheritance tax may apply to your estate. We will provide information and discuss strategies to minimise tax liabilities. Visit our inheritance tax page.

Digital Assets

Plan for access to digital assets like photos, videos, and cryptocurrencies. Without planning, these assets may be inaccessible. Business Interests

Executors need information to manage your business. Business Relief can make it tax-efficient to leave business interests in a trust. We will discuss what information your executors will need and how to best plan for your business interests.

Assets Abroad

You should have a Will that complies with the laws of any country where you own assets. This ensures efficient estate administration here and abroad. We will discuss your international assets and how to best manage them.

Engaged to be Married or Civil Partnership

Marriage or civil partnership revokes existing Wills. We can draft your Will to remain valid after marriage or partnership. We will discuss your plans and ensure your Will is up to date.

Pets

Provide guidance on the care of your pets. We will help you include instructions for their care in your estate plan.

Funeral Wishes

Include burial or cremation preferences in your Will or a side note. We will discuss your wishes (if any) and how to document them.

Organ Donation

Record your decision on organ donation at www.organdonation.nhs.uk/register-your-decision. We will discuss your preferences and how to ensure they are followed.

Side Letters

Use side letters to provide guidance to executors and guardians, such as contact details and care instructions for children. We will help you create side letters to ensure your wishes are clear.
